As of January 2022, USCIS has announced that the higher O-1 standard of “extraordinary achievement” that is applied to those working in the Motion Picture & TV (“MPTV”) industry will be expanded to include internet content. Hence, streaming movies, web series, and web commercials will now be adjudicated under the MPTV standard of extraordinary achievement. Social media will not generally be considered to fall under the MPTV category.

Further, artists whose activities span both the traditional arts forms and some MPTV activities will be held to the MPTV standard when the case is adjudicated.

“Extraordinary achievement” means the artist is recognized as outstanding, notable or leading in the field.
